Job Seeker Terms & Conditions

Welcome to The Talent Pool (the "Platform"), operated by Hansel Careers Ltd ("we," "us," or "our"). These Job Seeker terms ("Terms") govern your access to and use of our services. By creating an account, uploading documents, or using the Platform, you agree to be bound by these Terms.
1. Who We Are

2. Eligibility & Specialist Scope
The Talent Pool is a specialist platform designed exclusively for candidates whose previous employment was terminated solely due to a failure to pass mandatory professional examinations.
- Minimum Age: You must be at least 18 years old.
- Single Account: Users may only register and maintain one account.
3. The "Double Verification" & Mandatory Declaration
To maintain the integrity of the Platform for employers, you are required to provide a mandatory "Tier 2" declaration upon onboarding.
3.1 The Sole Reason Declaration: You hereby warrant and confirm that exam failure was the sole and exclusive reason for the termination of your previous employment.
3.2 Conduct & Ethics Warranty: You warrant that your exit was not related to any "Disqualified Matters."
3.3 Definition of Disqualified Matters: For the avoidance of doubt, "Disqualified Matters" includes, but is not limited to:
- Misconduct: Any breach of employer policy, bullying, harassment, or insubordination.
- Ethical/Integrity Breaches: Cheating or plagiarism in internal or external assessments; falsification of timesheets; or inflating/falsifying expense claims (regardless of whether the claim was paid or declined).
- Disciplinary Issues: Any termination resulting from a disciplinary process unrelated to academic grades.
3.4 Misrepresentation: If it is discovered that your exit involved a Disqualified Matter, we reserve the right to terminate your account immediately and notify any employers to whom you have been introduced.
4. Onboarding & Documentation
To use our matching services, you must:
- Complete the registration profile.
- Upload an up-to-date CV.
- Upload official exam transcripts related to your professional qualification.
- Answer all profile questions truthfully. Failure to provide accurate information is a material breach of these Terms.
5. Privacy & Permission-Led Data Sharing
5.1 Consent-Led Applications: We respect your privacy. While we use AI to identify matches, we will only pass your CV and exam transcripts to a specific company after you have explicitly confirmed on the Platform that you would like to apply for a role with them.
5.2 Employer Access: Once you confirm interest in a role, the relevant employer will be granted access to your profile, CV, and transcripts for the purposes of recruitment and background checking.
5.3 Transparency: We process your personal data in accordance with our Recruitment Privacy Notice. This notice explains your rights under the UK GDPR, including your right to access, rectify, or delete your data at any time. By using the Platform, you acknowledge you have been signposted to this notice.
5.4 Data Improvement: You agree that we may use anonymised data from your profile to improve our matching algorithms.
6. Acceptable Use & Platform Security
To maintain the security and integrity of The Talent Pool, you agree not to:
6.1 Technical Interference: Upload or transmit viruses, worms, or any malicious code that could affect the functionality or operation of the Platform.
6.2 Data Scraping: Use any robot, spider, or automated tool to "scrape", crawl, or extract data from our Platform or matching engine.
6.3 Security Breaches: Attempt to breach, probe, or test the vulnerability of our systems or circumvent any security or authentication measures.
6.4 Impersonation: Use a false email address, provide fraudulent transcripts, or pretend to be someone other than yourself to gain access to the Services.
6.5 Prohibited Content: Upload any content that is defamatory, obscene, or infringing on the intellectual property of others.
7. Our Liability
7.1 Outcomes: We facilitate introductions, but the final hiring decision rests with the employer. We accept no liability for any losses resulting from a failed application or a rescinded offer.
7.2 Vetting: While we perform basic checks, the ultimate responsibility of verifying your background and professional standing rests with the prospective employer.
8. General Terms
8.1 Governing Law: These Terms are governed by English Law. Any disputes shall be subject to the exclusive jurisdiction of the English Courts.
